Minimum wage underpayment: checks and complaints in Britain

Minimum wage underpayment can happen even when the hourly rate on your payslip looks correct. In Great Britain, checking paid hours, required work expenses and the relevant pay period can reveal a shortfall. Keep supporting records, ask payroll for an explanation and consider Acas advice before choosing a formal recovery route.

  • The advertised hourly rate is only part of a minimum wage check.
  • Required uniform costs and missing working time can affect compliance.
  • A payroll query and a formal grievance offer ways to challenge an error.
  • HMRC complaints and employment tribunal claims are different routes with different rules.

How can your pay fall below the minimum wage?

A contract can show the correct hourly rate while the pay calculation still leaves a worker short. The problem might involve hours omitted from payroll, required purchases or an incorrect assumption about which payments count. A headline about employers failing to pay staff cannot establish whether your own wages are correct.

According to Acas guidance updated on 1 October 2026, employers must maintain accurate pay records and put minimum wage underpayments right, including arrears owed to former workers. This article covers checks and routes relevant to England, Scotland and Wales. It does not apply British procedures to Canadian employment.

Start with the period covered by the payslip

GOV.UK explains that hourly paid work is assessed using average hourly pay over the period covered by the payment. Match the hours and pay to that period, rather than comparing a bank deposit with a single busy shift. Annual salaries and other payment arrangements have different checking methods.

Also distinguish statutory minimum wage pay from take-home pay. Income Tax and National Insurance deductions do not automatically mean an employer has breached minimum wage rules. The calculation is not simply the money reaching your account divided by the hours you remember working.

Which hours and expenses are worth checking?

GOV.UK guidance includes work-related travel and training among the activities that can count towards working time. Ordinary travel between home and work, and rest breaks actually taken, are excluded. The distinction matters when a rota shows appointments but leaves out travel between work assignments.

A useful evidence file separates time spent working from time genuinely off duty. Where an entry is disputed, record what happened and why you believe it was work. Unusual arrangements, including sleep-in duties, need specific guidance rather than assumptions based on the shift’s overall length.

  • Compare payslip hours with rotas, timesheets and shift messages.
  • Identify training and travel between work assignments that payroll may have missed.
  • Keep receipts for required uniforms, tools or other unreimbursed job expenses.
  • Separate tips from wages when reviewing the employer’s calculation.

According to GOV.UK, unreimbursed items bought for the job can reduce pay for minimum wage purposes. Tips cannot be used to bring wages up to the statutory minimum. These rules explain why a seemingly acceptable contractual rate may not settle the question.

Avoid treating every deduction as unlawful: different categories receive different treatment. Ask payroll to identify each deduction and explain its effect on the minimum wage calculation. Employer-provided accommodation is another area where separate rules can matter.

How can you raise a suspected shortfall with your employer?

Acas describes an informal discussion as a usual starting point. A focused written query can identify the affected payslip, the hours or expenses in question and the records supporting your concern. Ask for the calculation and an explanation of any correction.

Keep the first message factual rather than assuming deliberate wrongdoing. A missing timesheet and a disagreement over required clothing may need different evidence. Save the response so you can see whether payroll addressed the specific issue or only repeated your contractual rate.

When an informal query does not resolve it

A formal grievance means making a complaint through your employer’s grievance procedure. Acas says this can help resolve minimum wage problems without legal action. Include the unresolved points, relevant documents and the outcome you are seeking.

Do not assume an internal discussion leaves unlimited time for other action. Employment tribunal claims have strict deadlines, so early Acas advice matters if the dispute continues. Check the options while gathering evidence rather than waiting indefinitely for repeated promises of a reply.

Can you complain to HMRC instead of going to a tribunal?

GOV.UK’s complaints guidance, updated on 7 April 2026, says HMRC enforces the minimum wage on behalf of the Fair Work Agency. The pay and work rights complaint form is available through GOV.UK. You can report a former employer as well as a current one.

The form allows you to say that you do not want your identity disclosed to the employer. Someone else can also complain on your behalf, with the necessary permission. Confidentiality is worth discussing before submitting identifying details if you are concerned about the workplace consequences.

An employment tribunal claim is a separate option. Acas explains that the same minimum wage issue cannot go through both legal processes, and GOV.UK says an existing tribunal case prevents that complaint from being taken forward. Obtain advice on the appropriate route, deadlines and evidence before choosing.

Acas also explains that asserting minimum wage rights must not lead to worse treatment at work. Keep records of relevant changes to your hours or treatment after raising the issue. The legal distinction between an employee and a worker can affect the claims available following dismissal.

How can you manage bills while the pay issue is unresolved?

Understand your credit card statement

A suspected shortfall can leave everyday spending difficult to plan. Until an adjustment arrives, keeping a budget based on income actually received avoids committing disputed wages in advance. Record the payroll issue separately so it remains visible rather than disappearing into general spending notes.

If card payments are approaching, our guide to checking your first credit card bill in the UK and Canada explains which statement details to review. For food spending, the guide to comparing UK supermarket loyalty offers using unit prices covers a separate budgeting check. Neither replaces pursuing unpaid wages.

Canadian readers need local employment standards guidance rather than HMRC. Those working in Ontario can use our Ontario minimum wage pay stub checks as a starting point. The British complaint process described here is not a Canadian recovery procedure.
